The general basis we work on. Your proposal sets the scope, price and timescale for your project, and it takes precedence over this page.

01 Who we are
Tyneside Marketing is a digital marketing agency based in North Shields, Tyne and Wear, providing web design, search engine optimisation, paid advertising and related marketing services to businesses in the North East and across the UK.
These terms cover the general basis on which we work. The scope, price and timescale of any particular project are set out in the proposal we send you, and that proposal takes precedence over anything on this page if the two ever disagree.
02 Quotes and proposals
Prices shown on this website are starting prices. The price for your project is the one stated in your written proposal, which is fixed for the scope described in it.
A proposal is valid for 30 days from the date we send it. Work begins once you have accepted it in writing.
If the scope changes after work has started, we will tell you what the change costs before doing it. We do not bill for additional work you have not agreed to.
03 Payment
Website projects are invoiced 50% on acceptance and 50% on completion, unless your proposal says otherwise. Monthly retainers are invoiced at the start of each month.
Invoices are payable within 14 days. We may pause work on overdue accounts, and will always tell you before we do.
All prices exclude VAT where applicable.
04 Ongoing work and cancellation
There are no lock-in contracts. Monthly retainers run month to month and either side may end them with 30 days written notice.
If you cancel a website project after work has started, you are liable for the work completed to that point. We will show you what that covers.
05 Ownership
Once your invoice is paid in full, you own your website, its content and its design. Your domain name stays registered in your name throughout.
We retain ownership of any underlying tools, frameworks or components we reuse across clients, and of anything you have not paid for.
We may reference your project and results in our portfolio and case studies unless you ask us in writing not to.
06 What we can and cannot promise
We do not guarantee specific search rankings, traffic volumes or lead numbers. Nobody honestly can: search engines and advertising platforms change their systems without notice and competitors act independently of us.
What we do commit to is the scope of work in your proposal, honest reporting of what happened, and telling you when something is not working.
Where we quote past results, they are real and belong to the named client. They are not a prediction of what your business will achieve.
07 Third-party services
Some work depends on services we do not control, including Google, Meta, hosting providers and payment processors. We are not liable for outages, policy changes or account decisions made by those providers.
Where you pay advertising spend, that money goes to the platform, not to us. Our fee is separate and is stated in your proposal.
08 Your responsibilities
We will need timely access to accounts, content and feedback to keep a project moving. Where a delay is on your side, timescales move accordingly and we will tell you when that happens.
You are responsible for making sure any content, images or claims you supply are accurate and that you have the right to use them.
09 Liability
Our total liability in connection with any engagement is limited to the fees you have paid us for that engagement in the preceding 12 months.
We are not liable for indirect or consequential loss, including lost profits or lost business. Nothing here limits liability for death or personal injury caused by negligence, or for fraud.
10 Data protection
We process personal data in line with UK GDPR. How we handle data collected through this website is set out in our privacy policy.
Where we process personal data on your behalf as part of a project, we do so only on your instructions and for the purposes of that project.
11 Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
